Terms and Conditions
1. Legally Binding Agreement
By signing a contract, approving an estimate, or submitting any deposit or payment to Tsunami Softwash Pro, the Client acknowledges and agrees that they are entering into a legally binding agreement for services to be performed at the agreed upon price.
Any deposit or payment made shall constitute acceptance of these Terms and Conditions and shall serve as confirmation of the agreement, whether or not a physical signature is provided.
All deposits and payments are non-refundable. In the event the Client cancels or breaches this agreement, all deposits and payments made shall be retained by Tsunami Softwash Pro as liquidated damages and not as a penalty, as the parties acknowledge that actual damages would be difficult to determine due to scheduling, administrative costs, mobilization, and lost business opportunities.
2. Payments
Payment is due according to the agreed upon contract schedule. All outstanding balances are due immediately upon completion of services unless otherwise agreed to in writing.
Accepted payment methods include debit, credit, or cash unless otherwise specified in writing.
Any balance not paid when due shall accrue interest at the maximum rate permitted under Ohio law until paid in full.
Client agrees to be responsible for all costs of collection, including administrative fees, collection agency fees, court costs, and reasonable attorney fees incurred by Tsunami Softwash Pro in recovering unpaid amounts.
3. Water Usage
Client agrees to provide Tsunami Softwash Pro access to a functioning on-site water supply sufficient to complete the agreed upon services without compensation.
Client is responsible for ensuring that all exterior water sources are operational, accessible, and turned on prior to arrival.
If water is unavailable, insufficient, or inaccessible upon arrival, Tsunami Softwash Pro reserves the right to:
- Reschedule the service
- Provide water at an additional charge
- Apply additional service fees for delay, transport, or equipment adjustments
Any time lost due to unavailable or non-functioning water supply may result in additional charges.
4. Electrical Usage
Client agrees to provide Tsunami Softwash Pro access to a safe, properly functioning on-site electrical source as reasonably required to complete the agreed upon services without compensation.
Client is responsible for ensuring that exterior outlets are operational, accessible, and capable of supporting standard service equipment prior to arrival.
If electrical service is unavailable, unsafe, insufficient, or inaccessible, Tsunami Softwash Pro reserves the right to:
- Reschedule the service
- Utilize alternative power sources at an additional charge
- Apply additional fees for delay or equipment adjustment
Tsunami Softwash Pro is not responsible for electrical issues, breaker trips, or pre-existing wiring deficiencies.
5. Service Access and Return Trip Policy
Tsunami Softwash Pro requires active on-site water access and fully operational utilities at the time of arrival. These conditions are the responsibility of the property owner or authorized representative.
If our team arrives and service cannot be performed due to lack of water access or required utilities, the appointment will be classified as a Site Access Failure.
Because production routes, crew labor, fuel allocation, and scheduling capacity are reserved in advance, a $150 Return Trip Fee must be paid in full before a new service date is assigned.
All payments are non-refundable.
Prepaid services remain on account as a service credit and will be applied to the new appointment once the $150 Return Trip Fee is paid.
If a second Site Access Failure occurs, additional trip fees will apply.
By approving an estimate or scheduling service, the Client agrees to these terms.
6. Scheduling and Force of Conditions
Client acknowledges that all scheduling dates are estimated and subject to change based on weather, site conditions, equipment availability, safety considerations, labor factors, supply constraints, or other circumstances beyond the reasonable control of Tsunami Softwash Pro.
Tsunami Softwash Pro reserves the absolute right to reschedule, delay, or adjust service dates as necessary to ensure safety, proper application, surface integrity, and quality of workmanship.
Delays or rescheduling due to rain, wind, temperature fluctuations, lightning, unsafe conditions, equipment malfunction, material shortages, or other operational limitations shall not constitute breach of contract and shall not give rise to cancellation, refund, or damage claims.
Client agrees that scheduling flexibility is a material condition of this agreement.
7. Removal and Replacement of Property Items
Client is solely responsible for removing and securing all grills, furniture, planters, decor, vehicles, personal property, and any other movable items from service areas prior to the scheduled service date.
If items are not removed prior to arrival, Tsunami Softwash Pro may, at its sole discretion, relocate such items to complete the service. Any relocation performed by Tsunami Softwash Pro is done as a courtesy only.
Tsunami Softwash Pro shall not be responsible for damage, breakage, loss, storage issues, or displacement of any items not removed by the Client.
Additional charges may apply for time, labor, or delays associated with moving or working around personal property.
8. Courtesy and Site Safety
While Tsunami Softwash Pro is performing services, Client is solely responsible for keeping all children, pets, and other individuals away from the active work area.
Client agrees to keep persons and animals off treated surfaces until such surfaces are fully dry and safe for normal use.
Tsunami Softwash Pro shall not be responsible for injury, illness, or damages resulting from failure to keep persons or animals clear of active or treated areas.
9. Estimate Accuracy and Unforeseen Conditions
All estimates are based on visible conditions at the time of quoting and, where applicable, measurements, photographs, satellite imagery, square footage data, or information provided by the Client.
Web-based, virtual, or remote estimates are preliminary and assume standard levels of dirt, organic growth, staining, accessibility, and surface condition.
If excessive organic buildup, heavy insect accumulation, grease, embedded staining, severe oxidation, structural complications, accessibility limitations, safety concerns, or other unforeseen conditions are discovered upon arrival or during service, Tsunami Softwash Pro reserves the right to adjust pricing or scope of work accordingly.
Certain conditions, including but not limited to artillery fungus, may not be serviceable and are excluded from standard cleaning services unless expressly agreed to in writing.
Client will be notified of any material change in scope or pricing prior to proceeding.
10. Basic House Wash Package Limitations
Basic House Wash Packages include cleaning of the primary exterior siding surfaces only, unless otherwise specified in writing.
The following services are not included unless explicitly listed on the estimate or invoice:
- Roof cleaning
- Porch cleaning
- Deck cleaning
- Patio cleaning
- Driveway cleaning
- Walkway cleaning
- Fence cleaning
- Window cleaning
- Gutter brightening
- Paver cleaning
- Any detached structure
Any service not specifically described in the written estimate shall be considered excluded.
11. Product Warranties
All warranties are limited strictly to those offered by the manufacturers of any products applied during service. Tsunami Softwash Pro makes no separate, additional, or implied warranties of any kind, including but not limited to warranties of merchantability or fitness for a particular purpose.
Due to environmental conditions, surface age, prior maintenance, and material composition, results may vary and are not guaranteed unless explicitly stated in writing.
Client agrees to notify Tsunami Softwash Pro in writing of any concern regarding the services within seven days of completion so that an inspection and reasonable opportunity to address the matter may be provided.
12. Limitations of Stain Removal
Client acknowledges that certain stains, discolorations, and organic or inorganic materials cannot be fully removed through standard cleaning processes.
These may include but are not limited to tree sap, artillery fungus, shotgun mold, rust stains, oil stains, paint, dye transfer, oxidation, deep organic staining, mineral deposits, vine marks, and other embedded or chemically altered surface conditions.
Tsunami Softwash Pro does not guarantee complete stain removal unless explicitly stated in writing.
Failure to achieve full removal of such stains shall not constitute defective workmanship, negligence, or grounds for non-payment.
Where possible, visible limitations will be identified during the estimate process; however, some stains or conditions may only become apparent during or after cleaning.
13. Property Condition and Water Intrusion
Client represents and warrants that the property is structurally sound, properly sealed, and maintained in a weathertight condition prior to service.
This includes but is not limited to windows, doors, siding, roofing components, flashing, foundations, electrical fixtures, receptacles, light fixtures, and exterior penetrations.
Tsunami Softwash Pro is not responsible for water intrusion, electrical issues, interior damage, or related losses resulting from failed seals, deteriorated caulking, improper installation, structural deficiencies, or lack of maintenance.
Cleaning may introduce water to exterior surfaces in a manner consistent with normal rainfall exposure. Client acknowledges that any resulting intrusion caused by defective conditions shall not be attributed to Tsunami Softwash Pro.
14. Pre-Existing Conditions and Damages
Tsunami Softwash Pro is not responsible for damages resulting from pre-existing conditions, improper installation, age-related deterioration, structural defects, or lack of maintenance.
This includes but is not limited to loose or improperly installed siding, shingles, windows, doors, trim, gutters, mortar, concrete, caulking, electrical fixtures, paint, wood rot, surface oxidation, or any previously compromised surface.
Cleaning may expose hidden defects, deterioration, faded surfaces, oxidation, loose mortar, cracked seals, or other pre-existing issues that were not visible prior to service. The exposure of such conditions shall not be considered damage caused by Tsunami Softwash Pro.
Tsunami Softwash Pro shall not be responsible for water intrusion resulting from defective construction, failed seals, improper flashing, or structural deficiencies.
Client acknowledges that exterior cleaning involves the use of water, detergents, and pressure appropriate for the surface and agrees that normal operational methods do not constitute negligence.
15. Oxidation and Surface Reactions
Client acknowledges that oxidation, fading, chalking, streaking, tannin bleed, grain raising, and color variation are common conditions on exterior materials including but not limited to vinyl, aluminum, steel, cedar, natural wood, engineered wood, composite siding, fiber cement, Hardie board, stucco, and other coated or painted surfaces due to age, UV exposure, moisture, and environmental wear.
Cleaning may remove surface contaminants and reveal underlying oxidation, discoloration, fading, uneven coloration, or material inconsistencies that were not previously visible. The exposure of such conditions shall not be considered damage caused by Tsunami Softwash Pro.
Tsunami Softwash Pro shall not be responsible for discoloration, streaking, chalking, tannin bleed, grain changes, coating irregularities, or visibility changes resulting from pre-existing material conditions or deterioration.
16. Window Spotting and Glass Conditions
Window cleaning is not included unless expressly stated in writing.
Client acknowledges that exterior cleaning may result in temporary or permanent water spotting due to hard water, mineral content, existing window seal failure, or prior surface contamination.
Tsunami Softwash Pro is not responsible for spotting, streaking, hazing, fogging, or visibility issues that occur as a result of mineral deposits, failed window seals, or pre-existing glass conditions.
Multi-pane window fogging caused by compromised seals is a pre-existing condition and not the result of exterior cleaning.
Client understands that professional window cleaning may be required to restore glass clarity following exterior washing services.
17. Glass Film and Coating Reactions
Client acknowledges that certain types of glass, including tempered glass, Low-E glass, aftermarket window film, factory-applied coatings, or energy-efficient treated glass, may chemically react to cleaning solutions, minerals, oxidation runoff, or environmental contaminants.
Such reactions may result in purple haze, iridescent discoloration, spotting, or staining that was not previously visible.
These reactions are related to the composition, condition, or treatment of the glass surface and are not the result of improper workmanship.
Tsunami Softwash Pro shall not be responsible for discoloration, staining, or visibility changes resulting from pre-existing glass coatings, films, manufacturing defects, or mineral reactions.
18. Concrete and Masonry Surfaces
Client acknowledges that the appearance of concrete and masonry surfaces is influenced by age, curing methods, aggregate composition, prior treatments, environmental exposure, and subsurface conditions.
Cleaning may reveal imperfections, discoloration, surface wear, cracks, patchwork, color variations, or prior repairs that were previously concealed by dirt, mold, mildew, algae, or staining. The exposure of such conditions shall not be considered damage caused by Tsunami Softwash Pro.
Complete removal of oil, grease, rust, battery acid, fertilizer staining, efflorescence, mineral deposits, paint, silicone, gum, or deeply embedded contaminants is not guaranteed unless expressly stated in writing.
Heavy oil or grease contamination may require specialized treatment at an additional charge and may still leave visible shadowing beneath the surface.
Uneven surfaces, drainage issues, landscaping runoff, cracks, and settling may cause sediment redistribution during cleaning. Such sediment presence does not reflect defective workmanship.
Overspray onto adjacent areas is not included unless specifically contracted.
Client understands that uniform appearance across all concrete surfaces cannot be guaranteed.
19. Paver and Hardscape Surfaces
Client acknowledges that pavers, brick, and other hardscape materials vary in color, composition, porosity, joint stability, and prior maintenance history.
Cleaning may reveal pre-existing imperfections, color variation, joint erosion, surface wear, settling, efflorescence, polymeric sand loss, or prior repairs that were previously concealed by dirt, algae, moss, staining, or organic buildup. The exposure of such conditions shall not be considered damage caused by Tsunami Softwash Pro.
Complete removal of rust stains, oil, grease, battery acid, fertilizer staining, efflorescence, paint, silicone, gum, or deeply embedded contaminants is not guaranteed unless expressly stated in writing.
Heavy contamination may require specialized treatment at an additional charge and may still result in residual shadowing beneath the surface.
Cleaning may disturb joint sand or polymeric sand. Re-sanding or re-stabilization is not included unless specifically contracted.
Uneven settling, drainage issues, and landscape runoff may result in sediment redistribution during cleaning and shall not be considered defective workmanship.
Uniform appearance across all pavers or hardscape surfaces cannot be guaranteed.
20. Color and Tone Variation
Client acknowledges that wood type, age, prior treatments, weather exposure, moisture content, density, and natural characteristics significantly affect the final appearance of stain, sealant, or cleaning results.
Variations in color, tone, and finish may occur between boards and across the overall project. Such differences are natural and unavoidable.
Tsunami Softwash Pro makes reasonable efforts to provide an accurate representation of expected results; however, uniformity of color and tone is not guaranteed. Variations shall not constitute a defect in workmanship.
21. Media Release and Marketing Authorization
Client grants Tsunami Softwash Pro a perpetual, irrevocable, royalty-free right to photograph, record, and document the property before, during, and after services are performed.
Client authorizes Tsunami Softwash Pro to use photographs, videos, descriptions, testimonials, reviews, and project details for marketing, advertising, promotional, portfolio, website, and social media purposes without compensation.
No identifying personal information such as full name, address, or contact information will be published without consent.
Client waives any claim to compensation, ownership, or approval rights related to such media use.
22. Agreement and Release
By approving an estimate, signing a contract, or submitting payment, Client acknowledges that all specifications, scope of work, pricing, and Terms and Conditions have been reviewed and accepted in full.
Client authorizes Tsunami Softwash Pro to perform the services described in the written proposal or estimate.
Except in cases of gross negligence or willful misconduct, Client releases and holds harmless Tsunami Softwash Pro from claims for property damage arising from pre-existing conditions, loose siding, loose trim, deteriorated paint, aged materials, compromised seals, wood rot, or other structural deficiencies.
Any damage resulting from such pre-existing or defective conditions shall remain the responsibility of the property owner.
23. General Exclusions and Limitations
Tsunami Softwash Pro is not responsible for water intrusion, interior damage, fogging of multi-pane windows, failed window seals, defective construction, poor drainage, foundation cracks, or pre-existing structural deficiencies.
While every reasonable precaution is taken, exterior cleaning involves the application of water and cleaning solutions in a manner consistent with normal environmental exposure. Pre-existing seal failures, deteriorated caulking, or construction defects may allow moisture intrusion, which shall not be attributed to Tsunami Softwash Pro.
This agreement does not guarantee complete stain removal. Certain stains, discoloration, oxidation, or surface irregularities may remain despite professional cleaning efforts.
Client must notify Tsunami Softwash Pro prior to service of any delicate surfaces, specialty coatings, aftermarket treatments, or areas that cannot be exposed to standard cleaning solutions. Failure to disclose such conditions releases Tsunami Softwash Pro from liability related to those surfaces.
24. 12-Month Organic Growth Limited Warranty
Tsunami Softwash Pro provides a 12-month Limited Warranty on qualifying work performed.
Covered Surfaces
This Limited Warranty applies only to vertical vinyl and aluminum exterior siding surfaces that were fully cleaned and treated during the original service.
Partial washes, selectively cleaned elevations, touch-up services, and maintenance-only services are not eligible for warranty coverage.
Covered Condition
This Limited Warranty covers only the re-occurrence of standard atmospheric organic growth, including mildew, mold, and algae, on qualifying vertical vinyl and aluminum siding surfaces under normal atmospheric exposure conditions.
Minimum Qualifying Threshold
Warranty service is triggered only when organic regrowth exceeds a single contiguous affected section greater than 12 inches by 12 inches on a previously treated vertical siding surface.
- Areas smaller than 144 square inches do not qualify.
- Multiple separated spots may not be combined to meet the minimum threshold.
- Isolated specks, faint spotting, cosmetic discoloration, minor streaking, splash marks, or surface shadowing do not qualify.
Remedy and Service Cap
If a qualifying condition is confirmed, Tsunami Softwash Pro will provide corrective service in the form of spot treatment to the affected section only.
Corrective service applies strictly to the qualifying area and does not include full house rewashing, blending of elevations, cosmetic equalization, or restoration of surrounding surfaces.
This Limited Warranty includes a maximum of one corrective service visit per property within the 12-month warranty period.
Tsunami Softwash Pro retains sole discretion in determining cause, qualification, and appropriate corrective method.
Excluded Organic Growth
Green mustard algae, mustard algae, yellow-green algae, lichens, moss, embedded biological staining, and growth occurring in persistent moisture, heavy shade, vegetation-dense environments, ground proximity, or recurring damp conditions are expressly excluded.
Excluded Materials and Structures
This Limited Warranty applies only to qualifying vertical vinyl and aluminum siding surfaces. The following materials and structures are excluded from warranty coverage regardless of material type or cleaning method:
- All masonry and porous surfaces, including brick, block, stone, stucco, mortar joints, and similar substrates.
- All concrete and flatwork surfaces, including driveways, sidewalks, patios, pool decks, pavers, and retaining walls.
- All fencing, decking, gazebos, pergolas, railings, wood structures, composite decking, composite fencing, exterior accessory structures, and all horizontal surfaces.
Environmental and Habitat Exclusions
This Limited Warranty is valid only under normal atmospheric exposure conditions. Warranty consideration is void where any of the following conditions are present:
- Heavy shade or dense tree canopy
- Overhanging limbs or vegetation within 20 feet of treated surfaces
- Limited airflow
- Irrigation or sprinkler overspray
- Roof runoff concentration or gutter overflow
- Improper drainage or persistent dampness
- Repeated moisture saturation, ground contact, or debris accumulation against the structure
Customer acknowledges that such conditions accelerate organic regrowth and are environmental in nature, not indicative of cleaning failure.
Surface Contamination and Insect Activity Exclusions
This Limited Warranty does not cover surface contamination or insect-related conditions, including but not limited to:
- Dirt accumulation, wind-blown soil, airborne dust, or pollen
- Insect residue, midge droppings, spider droppings, or spider webs
- Wasp nests, hornet nests, mud dauber nests, dirt dobber nests, or bee activity
- Bird droppings or bat droppings
- Tree sap, resin, leaf tannins, or mulch staining
- Landscape overspray, fertilizer staining, road spray, soot, or exhaust residue
- Construction dust or debris
Spider webs, insect nests, and similar activity may reappear within days of service and are considered normal environmental recurrence, not organic regrowth or cleaning failure.
Non-Covered Conditions
This Limited Warranty does not cover oxidation, tiger striping, rust staining, hard water staining, efflorescence, paint failure, caulk failure, sealant failure, chemical damage, environmental fallout, or staining resulting from material deterioration.
Irrigation and Maintenance Compliance
Customer agrees to prevent irrigation overspray, repeated direct water exposure, debris accumulation, or ground contact against treated siding surfaces. Failure to maintain reasonable water control voids warranty consideration.
Warranty Verification Process (WVP)
All warranty claims must be submitted through the Tsunami Softwash Pro Warranty Verification Process (WVP).
Submission under the WVP requires clear, well-lit, high-resolution photo and video documentation of the claimed condition.
Documentation Requirements: Customer must submit a minimum of three photographs of the claimed area:
- One close-up image taken within 12 to 24 inches of the affected section
- One mid-range image taken approximately 5 to 8 feet away
- One wide-angle image clearly showing the full elevation or wall section for context
Customer must also submit one continuous video recording of the claimed area lasting no less than 15 seconds and no more than 45 seconds. The video must be recorded in daylight, must be steady and not blurry, and must clearly show the affected section, surrounding area, and visible structural reference points such as siding lines or trim.
Blurry images, zoomed digital enlargements, edited media, screenshots, low-light recordings, incomplete documentation, or media that does not clearly establish scale and location will not qualify for warranty consideration.
Tsunami Softwash Pro reserves the right to request additional documentation if necessary.
Service Evaluation Deposit (SED)
If Customer requests an on-site inspection under the WVP, a $125 Service Evaluation Deposit (SED) is required prior to scheduling.
The SED will be fully refunded if the claimed condition qualifies under this Limited Warranty.
If the claimed condition does not meet the qualifying criteria, the SED will be retained to cover travel time, inspection time, and administrative costs.
Tsunami Softwash Pro reserves the right to determine whether an on-site inspection is necessary based on submitted documentation.
Non-Transferable
This Limited Warranty is non-transferable and applies only to the property owner at the time of service.
Notification and Inspection
Customer must submit claims through the WVP within 12 months of the original service date.
Tsunami Softwash Pro reserves the right to inspect the property, verify conditions, and determine qualification prior to authorizing corrective service.
Failure to provide reasonable access for inspection voids warranty consideration.
Final Binding Acceptance
By submitting payment for services rendered, Customer irrevocably acknowledges, understands, and agrees to all Terms and Conditions outlined above in their entirety.
Payment constitutes full and unconditional acceptance of these Terms and Conditions, including all warranty limitations, exclusions, procedures, requirements, and remedies.
No verbal statements, prior discussions, marketing materials, estimates, proposals, or representations shall modify, override, or supersede these Terms and Conditions unless expressly agreed to in writing and signed by Tsunami Softwash Pro.
25. Limitation of Liability
To the fullest extent permitted by law, Tsunami Softwash Pro's total liability for any and all claims arising out of or related to the services provided shall not exceed the total amount paid by the customer for the specific service giving rise to the claim.
Under no circumstances shall Tsunami Softwash Pro be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of use, loss of property value, loss of income, or emotional distress.
26. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of Ohio.
27. Venue and Jurisdiction
Any dispute, claim, or legal proceeding arising out of or relating to this agreement or the services performed shall be brought exclusively in the courts located in Cuyahoga County, Ohio. Customer consents to personal jurisdiction and venue in those courts.
28. Right to Cure
Customer agrees to provide written notice of any dissatisfaction or alleged deficiency in service within seven days of service completion.
Tsunami Softwash Pro shall be given a reasonable opportunity to inspect and correct any verified issue before the customer hires third parties, initiates a payment dispute, files legal action, or seeks other remedies.
Failure to provide an opportunity to cure prior to pursuing further action shall constitute a material breach of this agreement.
29. Chargeback and Fraudulent Payment Disputes
Initiating a credit card chargeback, ACH reversal, bank dispute, or electronic payment dispute after services have been performed in accordance with this Agreement, without first complying with the Right to Cure provision, constitutes a material breach of contract.
Before initiating any payment dispute, Customer must provide written notice and allow Tsunami Softwash Pro a reasonable opportunity to inspect and cure the issue.
If a chargeback or payment dispute is initiated without complying with this requirement, Customer agrees to be responsible for the original service amount, all processing penalties, administrative costs, collection costs, court costs, attorney fees, and statutory interest at the maximum rate permitted under Ohio law.
Tsunami Softwash Pro reserves the right to pursue all legal remedies available to recover damages resulting from improper or fraudulent payment disputes.
